By accessing or using this website, you agree to be bound by the Terms and Conditions and accept them in full, as they may be modified by Outcomes Operating, Inc., or its affiliates or subsidiaries ("Outcomes") from time‑to‑time and posted on this website.

It is our policy to protect your personal information and to use it only in accordance with this Privacy Policy. Using the Site is voluntary, and by accessing or using the Site, you: (i) acknowledge that you have read and understood this Privacy Policy; (ii) agree that your access and use of the Site are subject to this Privacy Policy and related Terms of Use; and (iii) consent to our collection and use of your Non-Personal and Personally Identifiable Information as described in this Privacy Policy, as updated or revised from time to time. At all times, Outcomes reserves the right to disclose any information, including personally identifiable information, to comply with any applicable law, regulation, legal process or government request, to protect our rights or our property (including, without limitation) in the event of transfer of control of the company or substantially all of its assets), or during emergencies when safety is at risk, or for credit fraud protection and risk reduction purposes.

If you choose to access the Site from locations outside the United States of America, you do so at your own risk and subject to the laws of the United States of America, and you are responsible for compliance with any local laws. You may not use or export anything (including information) from the Site in violation of United States of America export laws, regulations or the Terms of Use.

Unless otherwise indicated, all content, video and other materials on or made available via this website, are the proprietary property of Outcomes and its licensors and are protected by U.S. and international copyright laws.

On the condition that you comply with all your obligations under the Terms and Conditions, Outcomes grants you a limited, non-transferable, non-exclusive, revocable license to access and use the website solely for your own personal or business purposes; provided, however, that, unless otherwise expressly permitted, you may not: (a) resell, lease, rent, or sublicense any access to the website; (b) modify or otherwise make any derivative uses of the website; or (c) use the website other than for its intended purposes. Except as explicitly stated herein, nothing in the Terms and Conditions shall be construed as conferring any license to intellectual property rights, whether by estoppel, implication or otherwise.


 

3. Privacy

Non-Personal Information. Outcomes automatically collects certain anonymous data regarding usage of the Site. The anonymous data we collect may include, without limitation, information such as:
  • Your IP address and if applicable, the IP address of the website from which you linked to the Site;
  • The language used to access and view the Site;
  • The type of web browser and operating system you are using;
  • The presence or absence of “flash” plug-ins;
  • Your screen resolution; and
  • The pages you visited and length of visit to the Site.

Such information (collectively, “Non-Personal Information”) does not personally identify users, by itself or in combination with other information. Outcomes uses this Non-Personal Information to monitor the effectiveness of the Site and to consider potential changes to improve the user experience. Non-Personal Information may be collected through cookies.

By providing a fax number or a phone number, including a mobile phone number, you consent to our collection and use of the number, such as to make calls and send faxes to you at the number provided for both informational and promotional purposes.

Outcomes uses PII collected through the Site in conjunction with responding to your requests for information or services. If you subscribe to a mailing list, we may use your email address or other contact information to send you messages, newsletters, special promotional offers, announcements, surveys and other commercial messages. If you no longer wish to receive such commercial messages, simply click the ‘unsubscribe’ link that Outcomes include at the bottom of every email that Outcomes send you. Please note that you cannot unsubscribe from certain correspondence from us. Outcomes may use third party service providers and suppliers to facilitate our operation of the Site and/or to do mailings on our behalf, and they may have access to PII. Additionally, Outcomes may provide PII to third parties for marketing purposes or to third parties that we believe have products or services of interest to you. Outcomes does not share your SMS consent with third-parties for the purposes of SMS messaging to such consented phone numbers.

Though Outcomes makes every effort to preserve your privacy, disclosure of your information to third parties for non-marketing purposes may occur in certain situations such as: (i) responding to a subpoena, court order or other such request; (ii) responding to a law enforcement agency’s request or as otherwise required by law; and (iii) providing your information to a third party if we file for bankruptcy, or there is a transfer of the assets or ownership in connection with proposed or consummated corporate reorganizations, such as mergers, acquisitions, or sales of business units. In all such instances, we will take the utmost care to disclose only that information which is necessary and appropriate under the circumstances.

Other Information NOT Collected. Outcomes services and your use of the Site do not require you to disclose, nor require us to request or collect, any credit card or other financial information, or any other personally identifiable information not described above. Outcomes does not request, solicit or intend to collect any such information and you should not disclose, enter or upload any such information on the Site. If Outcomes discovers that such information was disclosed by you, Outcomes will exercise commercially reasonable efforts to delete such information; however, Outcomes is not liable for any consequences relating to such disclosures of information.

 

4. No Unlawful or Prohibited Use

As a condition of your use of the Outcomes website, you warrant to Outcomes that you will not use the website for any purpose that is unlawful or prohibited by these Terms and Conditions. You may not use the Outcomes website in any manner which could damage, disable, overburden, or impair the website or interfere with any other party's use of the website. You may not obtain or attempt to obtain any materials or information through any means not made available or provided to you through the Outcomes website. Outcomes does not knowingly collect personal information from children under the age of 13. Children are not permitted to use the Site and we request that children under the age of 13 not submit any personal information to the website.

Outcomes has no control over any such other websites, the contents therein or the products/services offered. The existence of any such links shall not constitute an endorsement, representation or warranty by Outcomes of such websites, the contents of the websites, the products or services of the websites or the operators of the websites. Outcomes disclaims responsibility for the privacy policies and customer information practices of third‑party internet sites hyperlinked to our sites.

Outcomes may provide links on the Site to other sites of interest; however, we do not review or endorse the content of such sites and are not responsible for that content or the privacy policies of websites to which the Site links. If you provide any information to such third parties, different rules regarding the collection and use of your personal information may apply. You agree to indemnify, defend, and hold harmless Outcomes, its officers, directors, employees, agents, contractors, and representatives from and against all claims, liabilities, losses, expenses, damages, fines, penalties, judgments and costs, including reasonable attorneys’ fees, arising out of, related to, or resulting from any violation of the Terms and Conditions or any activity related to your use of the Outcomes website.

Outcomes may, at any time, make modifications, changes, and alterations to the Contents of this website, including these Terms and Conditions, without prior notice. You are responsible for regularly reviewing the Terms and Conditions. Your continued use of this website following any modifications, changes, or alterations shall constitute your acceptance of such modifications, changes, or alterations.

 

10. Waiver

No waiver by Outcomes of any right under or term or provision of these Terms and Conditions will be deemed a waiver of any other right, term, or provision of these Terms and Conditions at that time or a waiver of that or any other right, term or provision of these terms and conditions at any other time.

 

11. Governing Law; Forum

Any dispute between the parties regarding the subject matter of these Terms and Conditions will be governed by these Terms and Conditions and the laws of the State of Florida without regard to its conflict of laws provisions and the venue of any litigation arising from a dispute regarding these Terms and Conditions shall be in the District Courts of Orange County, Florida. The venue of any dispute resolution activity shall be in Orlando, Orange County, Florida.

 

12. Severability

If any provision of these Terms and Conditions shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms and Conditions and shall not affect the validity and enforceability of any remaining provisions.

 

13. Termination

Outcomes reserves the right, without advance notice and in its sole discretion, to terminate your license to use the website, and to block or prevent your future access to and use of the website.

 

14. Miscellaneous

Security. We strive to maintain the security of your information by using appropriate measures designed to protect our systems. However, we cannot guarantee the security of any information that is disclosed online. The Site is encrypted with algorithms and methods currently deemed acceptable by National Institute of Standards and Technology based on the classification of data stored, processed or transmitted. We also employ secure technology, privacy protection controls, and restrictions on employee access, to safeguard sensitive information. Notwithstanding the foregoing, we do not insure or warrant the security of any information you transmit, and you do so at your own risk.

 

California Residents. If you live in the State of California, under the California Civil Code, you have the right to request that companies who conduct business in California provide you with a list of all third parties to which the company has disclosed Personal Information during the preceding year for direct marketing purposes.

Alternatively, the law provides that if a company has a Privacy Policy that gives either an opt-out (often referred to as “unsubscribe”) or opt-in choice for use of your Personal Information by third parties (such as advertisers or affiliated companies) for marketing purposes, that the company may instead provide you with information on how to exercise your disclosure choice options.

All requests must be labeled “Your California Privacy Rights” on the subject of the actual request. For all requests, please include your name, street address, city, state, and zip code. Please include your zip code for our own record-keeping. Requests that are improperly labeled or that are missing the required information will not be processed.
